Terms of Use

1. Who can use the app

Imagine: Kids Coloring Book is designed for children. A parent or legal guardian must install the app, approve purchases, and supervise use. By enabling the app for a child, you accept these Terms on the child's behalf.

2. License

The developer grants you a limited, personal, non-transferable, non-exclusive, revocable license to use the app on Apple-branded devices you own or control, as permitted by Apple's App Store Terms of Service. You may not copy, modify, reverse-engineer, rent, lease, sublicense, or distribute the app except as permitted by law.

3. Free use, purchases, and payments

The app may include free custom AI coloring page generations and optional in-app purchases for additional pages or themed packs. Prices are shown before purchase and may vary by region.

Custom AI page packs

Parents or guardians may purchase consumable page packs for custom AI coloring pages. A page is used only when a custom AI page is successfully created or when a bundled prompt-card page is opened through the custom generation area. Failed server requests or fallback pages do not use a free generation or purchased page.

Page packs are consumable, do not renew, and may not sync or restore across all devices.

Themed packs

The app may offer ready-made themed coloring packs. Each pack may include one free page. A parent or guardian may unlock the full pack with a non-consumable in-app purchase.

Legacy subscriptions

Earlier versions of the app may have offered subscriptions. New purchases are page packs and themed-pack unlocks, not auto-renewing subscriptions. Active legacy access may still be honored where applicable.

All payments are processed by Apple. Refunds are handled by Apple under its policies and can be requested at reportaproblem.apple.com. Purchases are protected by a parental gate, and in-app purchases can also be restricted through iOS Screen Time settings.

4. AI-generated content and safety

The app uses OpenAI's image-generation API to create coloring pages from text prompts typed or spoken in the app. To help keep the experience appropriate for children, the app uses safety measures including:

• On-device prompt filtering before prompts are sent off device.
• Style enforcement for kid-appropriate black-and-white coloring-book images.
• OpenAI safety moderation.
• Parental gates for purchases, external links, and sharing.
• No chat, comments, public gallery, social feed, or user accounts.

AI-generated output may occasionally be imperfect, unexpected, or unsuitable. A parent or guardian should supervise use. If you encounter inappropriate output, report it through the app support information provided on the App Store listing, and we will investigate.

You are responsible for prompts submitted from your device. You agree not to attempt to generate illegal, hateful, sexual, violent, rights-infringing, or otherwise inappropriate content.

5. Your content

Drawings and coloring pages created in the app are yours and are stored on your device. You grant us no license over them.

6. Acceptable use

• Do not use the app for unlawful purposes.
• Do not disrupt, reverse-engineer, or probe the app, its servers, or third-party services.
• Do not bypass parental gates, filters, purchase controls, free-use counters, or page-pack balances.

7. Privacy

Your use of the app is also governed by our Privacy Policy.

8. Third-party services

The app may rely on services from Apple, Cloudflare, and OpenAI. Your use of those services through the app may also be subject to their respective terms and policies.

9. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind. We do not warrant that the app will be uninterrupted, error-free, free of harmful components, or that generated content will meet your expectations.

10. Limitation of liability

To the maximum extent permitted by law, the app developer will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, or loss of revenues arising from your use of the app. Total liability for any claim will not exceed the amount you paid through Apple in the twelve months before the claim, or USD $50 if you paid nothing.

11. Indemnification

You agree to indemnify and hold harmless the app developer from claims arising out of your violation of these Terms or misuse of the app.

12. Changes

We may update the app and these Terms from time to time. Material changes will be reflected by an updated effective date and, where appropriate, additional notice.

13. Termination

You may stop using the app at any time by uninstalling it. We may suspend or terminate access if you materially breach these Terms.

14. Governing law

These Terms are governed by the laws of the state of your residence within the United States, without regard to conflict-of-laws principles. If you reside outside the United States, local mandatory consumer protection laws may still apply.

15. Apple-specific terms

Because the app is distributed through the Apple App Store:

• These Terms are between you and the app developer only, not Apple.
• The developer, not Apple, is responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by applicable App Store terms.
• The developer is responsible for addressing claims relating to the app, including product-liability, legal-compliance, consumer-protection, privacy, and intellectual-property claims.
• You represent that you are not located in a country subject to a U.S. Government embargo or listed on a U.S. Government restricted-party list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
